When You Need a Hospital Notary

The need for a hospital notary typically arises in one of several situations:

Pre-surgical planning. A patient about to undergo a significant surgery may want to ensure their affairs are in order — particularly regarding who can make medical decisions if they're unable to do so post-surgery. A healthcare surrogate designation and living will notarized before surgery provides that protection.

Unexpected hospitalization. A sudden health crisis — a stroke, a fall, a serious diagnosis — can bring into sharp focus the absence of important legal documents. When a family realizes a loved one doesn't have a durable power of attorney and that person is still capable of signing one, the window may be limited.

Chronic or terminal illness. Patients managing serious, chronic, or terminal illness often reach a point at which they want to ensure their wishes are documented while they still can. Advance directives, healthcare surrogates, and sometimes changes to estate documents become important.

Nursing home and assisted living situations. Residents of care facilities sometimes need documents notarized for financial, legal, or estate planning purposes. We travel to these facilities regularly and are familiar with navigating the administrative process of visiting a patient.

Hospice situations. Some of the most sensitive and time-critical notarizations happen in hospice settings. We approach these with the utmost care, patience, and respect for the patient and family.

Documents We Notarize in Hospital Settings

Designation of Healthcare Surrogate. This document designates a specific person to make medical decisions when the patient cannot communicate their own wishes. It is one of the most important documents a person can have, and one we notarize frequently in hospital settings. Without it, medical providers must navigate a more complex process of family consensus or court appointment to authorize major medical decisions.

Living Will / Advance Directive. A living will records the patient's wishes about end-of-life care — including preferences around life-sustaining treatment, resuscitation, and artificial nutrition. It is a deeply personal document that relieves family members of the impossible burden of guessing what their loved one would have wanted. We approach these signings with the quiet respect they deserve.

Durable Power of Attorney. A durable power of attorney authorizes a trusted individual to manage financial affairs — banking, bills, property, investments — if the patient becomes unable to do so. For a hospitalized individual with ongoing financial obligations, this document can prevent serious practical problems during an extended illness or recovery.

Last Will and Testament. Florida law allows a notary to notarize a will, though wills have specific witnessing requirements that differ from standard POA documents. Wills require two witnesses and, for self-proving wills, a notarized attestation. We are experienced with will signings and ensure all requirements are properly observed.

Financial Affidavits and Business Documents. Patients sometimes need to execute financial affidavits, authorize transactions, or sign business documents while hospitalized. We handle these with the same professionalism as estate planning documents.

How Bedside Notary Service Works

The process is designed to be as simple and low-stress as possible for the patient and family.

Step 1: Call us. Contact us at (904) 567-6779 and describe the situation — what documents need to be notarized, which facility the patient is at, and the general timeline. We'll confirm whether we can accommodate the appointment and give you an honest assessment of how quickly we can get there.

Step 2: Coordinate witnesses. Most documents notarized in a hospital setting require two witnesses in addition to the notary. These witnesses cannot be related to the patient by blood or marriage, and cannot be beneficiaries of the patient's estate. Family members in the room may not qualify. We'll discuss this with you so you can plan appropriately.

Step 3: We arrive. We come to the patient's room. We work quietly, patiently, and professionally. We verify the patient's identity using government-issued ID or, in cases where the patient has no accessible ID, we use alternative identification procedures available under Florida notary law.

Step 4: Capacity observation. We pay careful attention to the patient's apparent capacity to understand and sign the document. While we are not physicians and cannot make legal determinations about capacity, we proceed only when it appears the patient is alert, oriented, and able to communicate understanding.

Step 5: Documents are signed and sealed. Once satisfied, we witness the signing, administer any required oaths, and apply our notary seal. The document is complete.

Frequently Asked Questions

How quickly can you get to a hospital? For urgent situations, call us directly at (904) 567-6779. We prioritize hospital calls whenever possible and will give you an honest estimate of how quickly we can get there. We cover the full Jacksonville metro area.

What if my family member doesn't have their ID at the hospital? Florida notary law allows alternative identification procedures when a valid ID is not available, including credible witness identification. We can discuss the available options based on your specific situation.

Can the notary be a family member? No — a notary cannot notarize documents for immediate family members in most practical situations, as this creates a conflict of interest. Additionally, the notary cannot serve as one of the two required witnesses.

What if my family member cannot hold a pen? Florida law allows a notary to assist a person who is physically unable to sign by directing someone else to sign at the principal's direction and in their presence. We can advise on this procedure and handle it properly.

Do hospitals allow notaries to come in? In general, yes — notaries visiting patients are treated similarly to other professional visitors. In some cases, especially in ICU or restricted-access areas, there may be additional steps. We recommend calling the nursing station ahead of our visit to ensure there are no obstacles.
